Terms and Conditions – Foundation Monument to the Battle of the Nations Leipzig
§ 1 Scope, Definitions
1.1. These Terms and Conditions apply, in the version valid at the time of the order, to all contracts concluded via the ticket shop of the Foundation Monument to the Battle of the Nations Leipzig (https://www.stiftung-voelkerschlachtdenkmal-leipzig.de) between the Foundation Monument to the Battle of the Nations Leipzig (hereinafter also “we” or “us”) and the customer (hereinafter also “you”). Deviating conditions of the customer are not accepted. This also applies if we do not expressly object to their inclusion. They are only recognized if their validity has been agreed in writing with the Foundation Monument to the Battle of the Nations Leipzig.
1.2. An entrepreneur within the meaning of these terms is any natural or legal person or partnership with legal capacity who, when concluding the contract, acts in the exercise of their commercial or independent professional activity. A consumer is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor independent professional activity.
§ 2 Conclusion of Contract and Contract Content
2.1. The customer can select the desired items from our assortment and specify the quantity. The items are collected in a so-called shopping cart via the “add to cart” button. In this “shopping cart”, which the customer can access at any time via the “shopping cart” symbol in the header menu, the customer is guided through the ordering process after clicking the “checkout” button, with each step explained and the required information requested. The customer can create a customer account, log in with an existing account, or place an order as a guest and must complete the order process by entering the required information. In the shopping cart, there is also the option to enter and redeem a voucher code in the “voucher code” field.
2.2. Before submitting the order, the customer can view and change the data at any time. The order process is completed via the “order with obligation to pay” button. The customer submits a binding offer to purchase the items contained in the shopping cart. However, the offer can only be submitted if the customer accepts these Terms and Conditions by clicking the “accept terms and conditions” button and thereby includes them in the offer.
2.3. The Foundation Monument to the Battle of the Nations Leipzig sends the customer an automatic confirmation of receipt by email, in which the customer's order is listed again and which the customer can print using the “print” function. The contract is concluded with this email through acceptance of the customer's offer.
2.4. The Foundation Monument to the Battle of the Nations Leipzig stores the contract text and sends the customer the order data and the contractual terms by email. This gives the customer the opportunity to retrieve and store the contractual terms in a reproducible form at the time of contract conclusion. Access to stored contract texts is only possible for registered customers via the customer account, except for the publicly accessible Terms and Conditions. The customer agrees to receive invoices electronically by email to the email address provided during the order.
2.5. The contract language is German.
§ 3 Tickets and Payment Terms
3.1. The customer can choose between different forms of tickets (online ticket for self-printing, mobile ticket via barcode or QR code, hereinafter collectively referred to as “ticket”). The tickets entitle entry to the Monument to the Battle of the Nations and the Museum 1813, subject to the house rules in their current version and available capacities. Temporary access restrictions may occur, particularly due to pandemics, official orders, or other necessary measures.
3.2. Payment can be made by credit card (Visa, MasterCard) or giropay/paydirekt. Where applicable, statutory VAT is included in the price. In the case of credit card and giropay/paydirekt payments, the customer's account is generally charged immediately after contract conclusion, depending on the payment service provider.
3.3. Additional costs may arise depending on the payment method. These will be displayed during the ordering process.
§ 4 Provision of Ordered Items
4.1. Tickets and vouchers are delivered electronically immediately after contract conclusion. This fulfills all obligations of the Foundation Monument to the Battle of the Nations Leipzig regarding ticket acquisition. Delivery by post, fax, or other means does not take place.
§ 5 Misuse / Violations of House Rules
5.1. The customer is responsible for selecting and using the correct ticket. Multiple printouts and reproductions for misuse are not permitted. This also applies to unauthorized transfers of personalized tickets and false information regarding eligibility for discounts (e.g., children, family, or group tickets). The Foundation reserves the right to verify such information.
5.2. Tickets acquired unlawfully or used improperly lose their validity. Persons who misuse tickets or violate house rules may be denied access and banned. No refunds will be issued. Filing of criminal charges and claims for damages remain reserved.
§ 6 Right of Withdrawal
6.1. If the customer is a consumer, they are entitled to a statutory right of withdrawal.
6.2. However, there is no right of withdrawal for distance contracts for the provision of services in connection with leisure activities if the contract provides for a specific date or period (§ 312g para. 2 sentence 1 no. 9 BGB). Tickets purchased online for a specific date or time period are therefore not subject to the right of withdrawal.
6.3. Where a right of withdrawal exists, the following applies:
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, have taken possession of the goods. In the case of services, the withdrawal period begins with the conclusion of the contract.

You may use the model withdrawal form below, but it is not mandatory. If you wish to withdraw from the contract, please complete this form and return it.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Consequences of Withdrawal of Purchased Goods
If you withdraw from this contract, we shall reimburse to you all payments received from you, including delivery costs (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. For this reimbursement, we will use the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in no event will you be charged any fees as a result of such reimbursement.
We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
In this case, you shall send back the goods or hand them over to us, Foundation Monument to the Battle of the Nations Leipzig, Straße des 18. Oktober 100, 04299 Leipzig, without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired. You will bear the direct cost of returning the goods. You are only liable for any diminished value of the goods if this loss in value is due to handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
For electronically transmitted items, apart from the declaration of withdrawal, no further steps are required; the voucher code will be automatically deactivated. After each withdrawal, the issued voucher code will be blocked in the system and permanently rendered unusable.
If the voucher has already been partially or fully redeemed, you must compensate the value of the amount already redeemed in the event of withdrawal.
Consequences of Withdrawal of Services
If you withdraw from this contract, we shall reimburse to you all payments received from you, including delivery costs (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. For this reimbursement, we will use the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in no event will you be charged any fees as a result of such reimbursement.
If you requested that the services begin during the withdrawal period, you shall pay us an appropriate amount corresponding to the proportion of the services already provided up to the time you informed us of the exercise of the right of withdrawal in relation to this contract compared to the total scope of the services provided for in the contract.
§ 7 Set-off, Right of Retention
7.1. The customer shall only be entitled to set-off if their counterclaims have been legally established, acknowledged, or arise from the same contractual relationship.
7.2. The customer may only exercise a right of retention if their counterclaim arises from the same contractual relationship.
§ 8 Warranty
The Foundation Monument to the Battle of the Nations Leipzig shall be liable for material and legal defects in accordance with the applicable statutory provisions.
§ 9 Final Provisions
9.1. Amendments or additions to these terms and conditions must be made in writing. This also applies to the waiver of this written form requirement. Notwithstanding this, informal amendments or additions shall also be effective if they constitute individual agreements within the meaning of § 305b BGB.
9.2. The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory provisions of the country in which the customer has their habitual residence shall remain unaffected.
9.3. If the customer is a merchant, a legal entity under public law, or a special fund under public law, the place of jurisdiction for all disputes arising from this contractual relationship shall be the registered office of the Foundation Monument to the Battle of the Nations Leipzig. This also applies if the customer has no general place of jurisdiction in Germany, moves their residence abroad after conclusion of the contract, or their place of residence is unknown at the time the action is brought.
9.4. Should individual provisions of these terms and conditions be invalid or contradict statutory provisions, the validity of the remaining provisions shall remain unaffected.
9.5. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
